My dentist refuses to take responsibility. What do I do?

I went to the dentist to get a route canal and nerve treatment. After a few weeks, she said my tooth was fine and treated. Later on, I went to my original dentist because my tooth was in so much pain. He told me that my tooth was not fully treated and basically rotting. I went back to the dentist who was treating me and at first she agreed to fix it and apologized. She began giving me treatment again, however...after one treatment she said she couldn't fix it. She refuses to help me any further and will not return my money. The nurse who works for the dentist says all my medical records are missing...What do I do now? Who do I report it to?

Now, I have seen records be misplaced, but they usually turn up on one of the assistants desks, like mine.LOL Your records are in that office, and I would just keep calling until they find them.





As for the rootcanal, you need to be aware that about 20% of all root canals are unsuccessful. Now, if the dentist who did it, did it improperly, they have a moral obligation to fix it, or to refer you to someone who can. In my office, if we knew that we had done all we could do to properly fix a tooth and it was still unsavable, we would credit what you paid towards a suitable replacement. If you refused to allow us to fix the problem, we would not give you back the entire amount paid, if we knew without a doubt that we didn't do anything unethical or wrong.





I don't know what the exact reason that your root canal failed is. Was it cracked? Did she leave decay in the tooth? Did she not remove all the nerve? Was there an accesory canal? All those are important things to know, when trying to determine if this dentist is liable.





You can try to contact your states board of dental examiners, but you will need your records.
Reply:What you do is you get yourself a lawyer and sue everybody for medical malpractice.
Reply:I would try to do a little background research on that particular dentist, see what kind of information you can find and then maybe try to contact the local dental association and see if anyone there can help. In the meantime go ahead and find another dentist to get that tooth fixed if you haven't already done so. Good Luck!!!
